久しぶりに、丸善に行きました。日本橋の丸善と、新丸ビルの丸善です。
サブプライム関連の本を探しにいったわけではないのですが。。。
経済関係（サブプライム関係の本も）が読みきれないほど並んでいました。
面白そうな本もあったのですが、宝島新書の「サブプライム問題とは何か」を買ってきました。
小さい本で、持ち歩きやすいので、この本に決めました。

今回は、再び住宅用不動産証券化です。

難しいのは第三者対抗要件という法律用語です。
法律の専門用語です。
ウィキペディアで調べました。

対抗要件（たいこうようけん）とは、すでに当事者間で成立した法律関係・権利関係（特に権利の変動）を相手方の当事者又は第三者に対

して対抗（主張）するための法律要件をいう。

日本の民法は、物権変動や債権譲渡などは当事者の意思表示のみによって成立するという原則（意思主義）を採用している（前者について

は、第176条）。
しかし、法律関係・権利関係は五感の作用により直接感知できるものではない。
そこで、第三者が法律関係・権利関係の存在を感知できるような何らかの外部的徴表（めじるし）が必要となる。この外部的徴表として、対抗要件の制度が設けられている。

不動産の登記などが、対抗要件の典型例である。
